In accordance with Article 17.1 of Law 19/2014, the Generalitat de Catalunya© allows the reuse of content and data as long as the source and date of update are cited and the information is not distorted (Article 8 of Law 37/2007); also that it does not contradict a specific license.
Terms of use and modalities of reuse of information
Law 18/2015, of the 9th of July, which amends Law 37/2007, of the 16th November, on the re-use of public sector information, regulates the re-use of public information held by administrations and bodies in which they have a majority stake, i.e. the right of all potential market players to re-use information held by public bodies.
In accordance with these regulations, the Administration allows the reproduction, distribution and public communication of the work and, in addition, the transformation of the work to make derivative works, for everyone and without time limitation, and provided that it does not contradict the license or notice that a work may have and which prevails.
To reuse the information, the following conditions must be met:
a) Do not distort the meaning of the information.
b) Always quote the source of the information, which is “Generalitat de Catalunya©. Department of Business and Knowledge. Consorci de Comerç, Artesania i Moda de Catalunya” (Consortium for Trade, Crafts and Fashion of Catalonia)
(c) Mention the date of the last update of the information.
Other re-use modalities
Furthermore, re-use may be limited by the protection of other priority legal assets, such as the protection of personal data, privacy or the intellectual property rights of third parties. The re-use of works protected by intellectual property can be formalised through the use of open broadcasting licences, such as Creative Commons licences, which transfer certain rights regarding re-use the works. In the contents where this type of license is applied, reuse is allowed under the conditions established in the license.
Under no circumstances is the use of logos, brands, coats of arms and distinctive symbols of the Consorci de Comerç, Artesania i Moda de Catalunya (Generalitat de Catalunya©) authorised in publications and websites that are not participated in or sponsored by the Consorci de Comerç, Artesania i Moda de Catalunya. These corporate graphic identity elements are the exclusive property of the Consorci de Comerç, Artesania i Moda de Catalunya (Generalitat de Catalunya©) and are protected by the applicable legislation in force.
